Piracy websites don't always get taken down straight away for a number of reasons, such as it being hosted in various other countries (or just have identical "mirror" sites). Just because something is easy to find, doesn't make it legal.

Also the whole 'not actually illegal to use the rom' thing is mostly a myth. It is illegal to pirate and use pirated content. Copyright and protection law is incredibly complex with a lot of grey area (there's a reason you need to study for like 10 years for this stuff). This also means there's a lot of misinformation about it.
