I know that I'm not a part of this matter, but I feel that spam constitutes anything that's unwanted, irrelevant, etc. Random garbage. The rule about avoiding irrelevant comments is essentially saying "don't comment random garbage".
I'd also advise against telling the mod who unbanned you from a ban that was supposed to be permanent to "get your warnings right". Questioning a mod's decisions is fine, but do it respectfully.

How is it not? Should everybody have an allowance for how many times they deliberately post rubbish in the Q&A?
