Why is my Fake Out failing?

I was fighting a Slaking (in Emerald) and my Sableye used Fake Out. It worked, and the foe flinched. But every time after that it failed. It was about 6-8 times in a row that Fake Out failed. Why did it keep on failing?

Fake Out only works the first turn the user is in battle, sadly. Switching it out and back in again allows it to use it multiple times however.
